EMU AAUP Chapter Meeting September 29, 2004

1. President Sally McCracken called the meeting to order in Tower Room, McKenny Union, at 12:05 p.m. Susan Moeller moved (Don Pearson second) approval of the March 17, 2004 minutes. The motion passed, 8-0, with two abstentions.

2. CONTRACTUAL COMMITTEE APPOINTMENTS: In keeping with the new contract, EMU-AAUP will appoint members to serve on the following committees: Committee on the Future of Instructional Delivery (Continuing Education), Health Care, Student Course Evaluations, Technology Transfer, Intellectual Property, and Salary Differential Pool. EMU-AAUP members of the Instructional Delivery (CE) committee will be Howard Bunsis, Susan Moeller, and Lynn Nybell.

3. TREASURER REPORT: Howard Bunsis reviewed the chapter’s financial condition, including a comparison with prior years. The chapter spent about $12,000 on negotiations in 2004; a previous executive committee spent about $25,000 in 2000. He projects a $88,351 surplus for 2004-2005, even with a dues reduction. Jamin Eisenbach suggested that chapter officers tell members that dues have dropped 10% (from 1% of salary to .9% of salary). Don Pearson asked about detailed spending within broad categories. Jamin urged officers to tell members that the grievance expenses did not include any money for compensating chapter officers. Carol Haddad asked why attorney costs are so large. Kate Mehuron moved (Jamin second) approval of the 2004-2005 budget, and the motion passed, 12-0, with one abstention.

4. GRIEVANCE REPORT: Mark Higbee and Susan Moeller, co-grievance officers, stated there were two grievances of tenure denials in 2003-2004. One was settled favorably, permitting the faculty member to reapply. The other is headed to Step 3 hearing. Next, another grievance stems from management failing to meet federal visa requirements, resulting in the mid-semester deportation of a faculty member. Third, AAUP is at Step 3 on the abolition of the head of Geography/Geology without faculty input. Fourth, we are going to Step 3 on the denial of spring teaching on the basis of faculty qualifications. Fifth, AAUP won the reversal of a promotion denial. Continuing Education is still a major problem (right of first refusal for faculty over lecturers; pay for inload classes). Finally, in the case of a fired faculty member, AAUP won at the arbitration level, but EMU refused to reinstate; a court supported management, and AAUP is appealing. In another legal case, Cheryll Conklin’s suit against EMU-AAUP for wrongful discharge is in the hands of the chapter’s liability insurance carrier. Chapter attorney Barbara Harvey is being used a little. There will be no financial impact for the chapter.

5. NOMINATIONS AND ELECTIONS COMMITTEE: All elected positions are open for terms to begin January 1, 2005 and to end January 1, 2007. Nominations are open through the chapter meeting of October 20. Candidates must submit statements by October 27 at 4 p.m. and may review copy by October 29. Ballots will be counted December 3. Flyer will be sent electronically to all faculty and will be available for stewards to put paper copies in faculty mail boxes. Carol Haddad moved (with a second) that the flyer be available in faculty mail boxes. Motion passed 11-0, with one abstention.

6. NOMINATIONS: The following names were placed in nomination: President: Howard Bunsis, Accounting; Vice-President: Jim VandenBosch, Biology; Treasurer: Susan Moeller, Finance; Secretary: Mike Homel, History; At-Large: Mark Higbee, History; Lynn Nybell, Social Work; Caroline Gould, Teacher Education; and Paul Leighton, Sociology, Anthropology, and Criminology.

7. There was no OLD BUSINESS or NEW BUSINESS.

8. MEMBER COMMENTS concerned grievance officers on the executive committee, the letter to the Governor this summer, adversarial relationship with the administration, lecturers’ inclusion in the faculty bargaining unit, the regents’ presidential search, and other matters.
